Personal Service, or court clerk's certified mail with return receipt.

Fifteen to forty-five days from service.

Not Allowed.

Either party may request a transfer, to have the case tried under formal Rules of Civil Procedure in District Court; or defendant counterclaim exceeds $3,000.

Either party may file an appeal for a new trial to the Small Claims District Court judge within 7 days of judgment if the case was before a district court magistrate. Otherwise, not allowed.

Plaintiff may only file 5 claims in a year and no more than 5 claims in one week. No equitable relief. Right to sue may not be transferred. No intentional torts or fraud cases. No jury trial. The court may refer cases to mediation or arbitration.
